No one with even an adequate grasp of linguistic analysis will argue otherwise. The ascription of the right to "the people" is unequivocal, and the structure of the introductory clause is not such that it restricts that right to the militia (it instead provides a justification for preserving the people's right).

I'm not qualified to offer an opinion on the legal aspects...not my field.
