I guess the government will have to prove if she was declaring the income or NOT. If she didn't advertise using SNAP benefits to purchase ingredients for her sale items, then the government will have to prove that too.

Food is fungible, prove that egg is a SNAP benefits egg, or did it come from a food bank, a friend, another source of income? The burden of proof is on the government. Innocent until proven guilty.

A good lawyer would chew the prosecutor up and spit him out.
