2. Would seem unconstitutional

Mostly in terms of a state constitution. Usually the various powers of government are defined there. There might be some US Constitutional problems since the constitution ensures a "republican form of government" by the states. It would seem that these changes would threaten that, or at least the process by which it is being done.
