The Dems actually are in the minority right now. O'Connor was endorsed by the GOP, but she's not a lunatic and sides with the Constitution(s) and with the Democratic endorsees much of the time. It's more important to make sure the balance tips to the Democratic endorsees, but it would be better if Brunner were CJ than a GOP-endorsed CJ. If it's a majority GOP court with a GOP-endorsed CJ, we're kinda' screwed.
