(11,103 posts)Nobody has any power or authority to do anything to prevent any member of the new House of Representatives from being seated on Jan 3, 2027 (all 435 members will be sworn in at once).
The Speaker has no role in seating and swearing in the new Congress because at thaat point he is no longer speaker. His term as speaker ends Jan 3, 2027 as do the terms of all 435 members of the House. Those people who are reelected still need to be re-sworn in just the same as new members. That is done by the House Clerk, a non-partisan position. This will also happen on Jan 3, 2027. The clerk also conducts all business until a new Speaker is elected (could be the same as the old speaker).
Also, approximately half of all House seats are in states with Democratic Governors so there is basically 0 chance of those elections not being certified.
