the 1st question that popped into my head.

The governor is a state office but the court is a county level.

The plaintiffs should refile in the Alabama state court system.

And this judge might've done the plaintiffs a favor by kicking it back so quickly as they have time to refile.

If the judge had ruled against Tuberville, it would have been certainly appealed to a Tuberville friendly judge who would have put a stay on place of the county judge's order and then slow-walked it until it became a moot point.
