7. NDA's don't apply to subpoenaed testimony.

You can refuse to answer a question because it might incriminate you. You can't refuse to answer a question because you signed a contract with someone where you agreed not to disclose information. (Also, NDA's are not enforceable to prevent the disclosure of criminal activity to legal authorities.)
