3. I thought it's only the Senate where the VP has the tie-breaker?

In any case I'm pretty sure it's inaccurate to say the thing "failed by one vote", as if a Democrat is responsible for the failure. In reality, it failed by two votes, because a tie would've gone to the GQP, by one means or another.
