The initial request for a stay pending appeal filed by DOGE was directed to Roberts as the Justice responsible for handling such requests arising out of the US District Court for the District of Columbia. If Roberts had denied it, DOGE could have renewed its request in front of any Justice it chose -- including Thomas or Alito. And they might have issued a more sweeping stay than the one issued by Roberts. So as is often the case, the stay issued by Roberts may be a defensive maneuver to keep control of the matter rather than leave it the hands of a Justice chosen by DOGE.
