12. Somehow there must be some strong level of evidence of self defense

That’s the only real answer. The shooter can be investigated and charged after the fact, but often a shooter is not arrested or taken in if it’s clearly self defense. There seems to be lack of clear witnesses and the video didn’t capture the minute leading up to the actual shooting.
