One: It's Trump and his concept of "The Art of the Deal", and

Two: It would get thrown out in Court. You can't have a settlement without a filed claim. Otherwise, it's a mere agreement. BTW, per Contract Law, an agreement whose terms are based upon illegal terms is illegitimate and unenforceable.
