Theyre killing machines: Newtown families have a right to sue the makers of the AR-15
Cedric Larry Ford gunned down three and injured at least 14 more with an automatic rifle in Kansas Thursday, blasting away randomly from his car and then in the industrial building where he worked. Just another day in America.
This nation cannot awaken from a nightmare: Madmen wield weapons of war to indiscriminately slaughter, in their workplaces, on streets, in movie theaters and in elementary schools.
Ford added to the tally of slaughter as Connecticut Superior Court Judge Barbara Bellis is considering the merits of a wrongful death suit brought by family members of Sandy Hook Elementary School children and one survivor of that assault.
They are trying to sue Remington, Americas top manufacturer of guns and ammunition in the civilian marketplace, for negligent entrustment in manufacturing AR-15s for purchase and use by ordinary Americans.
These assault rifles are weapons of war.

OK controllers, what army uses AR-15s as their infantry rifle?
The civilian version of the AK-47 is not automatic but semi-automatic, giant difference.
not even going to go there on the assault rifle bull.
By the way, the Kansas guy was a prohibited person and could not lawfully get a weapon and there appears to be a straw purchase by an old girlfriend and she has been charged.

(17,502 posts)and punishable up to ten years in the federal pen. Most gun people I know have a problem with the sentencing guidelines in such cases. For example, there was outrage among all the gun blogs about a straw purchaser who bought several guns for biker gang types but got a year probation.
One thing I would liked for Obama do to with his EOs to address that if he legally can and order DoJ to prosecute felon in possession cases the locals give them.

(18,606 posts)"right to sue" - Everyone has a right to attempt to recover losses due to the actions of another where actions by the other are criminal or negligent. First, the manufacturers of the weapons used at Sandy Hook were neither and, second, the PLCAA protects them from SLAPP suits as they are breaking no laws in the conduct of their business. Idiots in the media who want to use the plight of survivors, their families and the families of the victims to profit through ratings and sales are scum. Lawyers who do anything but warn away those contemplating such lawsuits are worse.

Lawyers and doctors have traditionally studied Latin. Not so much to read legal or scientific texts in their original language but in recent times partially to gain an appreciation for the precision of thought able to be conveyed by language with very particular vocabulary. The rifle used was SEMI-AUTOMATIC made to LOOK LIKE an AK-47. Is a knife that stabs once per flex of an arm an "automatic" knife?

Were I a director or executive at Remington, I would have corporate counsel investigate case law and any relevant criminal laws on malicious prosecution. I would further suggest dedicating any monies so recovered and urge my fellow executives and directors to start or further contribute to a political action committee whose aim is to pass criminal barratry laws in every state where the company has nexus.

This proves that the most popular civilian rifles in U.S. homes must be banned and confiscated from non-felons and the mentally competent, even though rifles remain the least misused of all weapons in America (less than 300 murders/yr out of 12,000+), and even though banning said rifles wouldn't do anything whatsoever to address criminal gun misuse or mass shootings.
If you want to know how the U.S. gun control lobby has been continually shooting itself in the foot since the early 1980s, there you go.
