Trump Says Congress Should End Birthright Citizenship After Supreme Court Ruling

President Donald Trump called on Congress to put an end to birthright citizenship in an effort to bypass the U.S. Supreme Courts Tuesday ruling on the matter in Trump v. Barbara.
The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process, Trump said in a Truth Social post. No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!
Trump also posted a link to an article on Truth Social earlier on Tuesday, suggesting that his efforts to end birthright citizenship could happen with or without the Supreme Courts approval.
The highly anticipated ruling, which experts had expected to go against Trump, comes after Trump signed an executive order last year, on the first day of his second term, to end birthright citizenship. Established by the 14th Amendment, birthright citizenship grants automatic citizenship to anyone born in the U.S., no matter the immigration status of their parents. At the signing of his order last January, he said that birthright citizenship is absolutely ridiculous.

(639 posts)The majority held that birthright citizenship is protected by the 14th amendment, not that it's protected by federal law.
Hence, any law limiting it would be struck down 5-4 as unconstitutional.
Trump doing this is just going to convince his followers that congress could change it but is refusing. He probably thinks it'll help him keep control of congree, but I think ita more likely to convince the republican base that their reps are useless and drive down R turnout this fall.

(23,099 posts)I suspect the latter. When someone says a thing is in the Constitution, he has no idea what that means. Because he's never read it, and wouldn't understand it if he tried. He'd have to have someone translate it into fourth grade level Engllish, and then he wouldn't read it anyway because he'd get bored after a couple of sentences.

(377 posts)Five of the justices said we have birthright citizenship under the 14th Amendment. Thus you do need a Constitutional amendment to get overturn it.
