18 States Sue to Stop Trump's Birthright Citizenship Order

Attorneys general from 18 states sued President Trump on Tuesday to block an executive order that refuses to recognize the U.S.-born children of unauthorized immigrants as citizens, the opening salvo in what promises to be a long legal battle over the Trump administrations immigration policies.
The complaint, filed in Federal District Court in Massachusetts was joined by the cities of San Francisco and Washington, D.C.
The states view Mr. Trumps attempt to limit birthright citizenship as extraordinary and extreme, said New Jersey Attorney General Matthew J. Platkin, who led the legal effort along with the attorneys general from California and Massachusetts. Presidents are powerful, but he is not a king. He cannot rewrite the Constitution with a stroke of the pen.

(866 posts)Trump has not yet gotten control of the U.S. military and can't yet use it to quell dissent.
If somehow the American people could rise up en mass NOW and all across the country to reject Trump's authoritarianism, he could be stopped.
Even without the help of MAGA and Trump voters, he could be stopped.
But it would take literally half the country to do this. Crowd sizes similar to the George Floyd protestors would be crushed by local law enforcement throughout the country.
But they wouldn't be able to crack down on half the U.S. population.
The big question is how? How could that be brought about and how could that be brought about quickly?
If our democratic elected officials at all levels of government unified and pushed to make this happen fast, then that would be our best chance.
Sadly, I don't see them doing that without quick and completely overwhelming pressure from us.
Literally tens of millions of us would have to flood their email, their phone lines, their social media, and their offices with demands that they do their best to get the American people to stand up en mass against Trump and his agenda. By stand up, I mean take to the streets and shut society down until Trump withdraws his authoritarian executive orders and backs down.
This is possible at least in theory.
Trump has not yet consolidated his power.
But we're quickly running out of time.

The lawsuits allege that a Trump executive order signed Monday violates the 14th Amendment of the Constitution, which gives a constitutional right of citizenship to all children born in the United States.
Despite a Presidents broad powers to set immigration policy, however, the Citizenship Stripping Order falls far outside the legal bounds of the Presidents authority, states a lawsuit from 18 states, Washington, DC, and San Francisco......
Also Tuesday, the attorneys general of Washington, Arizona, Oregon and Illinois brought their own lawsuit on the west coast. It was filed at a federal court in Seattle that is within the 9th US Circuit Court of Appeals, a traditionally left-leaning court that has become less liberal in recent years.
Both suits are also seeking a preliminary order blocking the policy before the Trump administration can take steps to implement it.
Similar lawsuits targeting Trumps order were brought by the American Civil Liberties Union and immigration rights groups on Monday
