US supreme court rejects Trump bid to call off sentencing in hush-money case

Source: The Guardian

Thu 9 Jan 2025 19.20 EST

The US supreme court on Thursday declined to delay Donald Trump’s upcoming sentencing in his hush-money case.

Trump had asked the US’s highest legal body to call off Friday’s sentencing in the hush-money case after New York courts refused to postpone the sentencing by Judge Juan Merchan.

Merchan presided over Trump’s trial and conviction last May on 34 felony counts of falsifying business records. Trump has denied wrongdoing.

Merchan has indicated he will not impose jail time, fines or probation, but Trump’s lawyers argued a felony conviction would still have intolerable side-effects, including distracting him as he prepares to take office in just over a week’s time.

(per legal pundit on TV), legally it takes a sentencing hearing to label one as a FELON. Dumpy can still appeal the conviction but he will ALWAYS be referred to as a felon in his orange legacy.

9. Donald Trump can be sentenced Friday in hush money case, Supreme Court says in 5-4 ruling
Thu Jan 9, 2025, 07:51 PM

I am happy that trump is not above the law. The briefs filed by trump's counsel were really sad and ridiculous. Basically it was the position of trump and his attorneys that trump was totally above the law

https://www.cnn.com/2025/01/09/politics/supreme-court-donald-trump-sentencing

President-elect Donald Trump can be sentenced Friday in his New York hush money case, the Supreme Court said in a 5-4 ruling.

The high court on Thursday rejected Trump’s emergency request to delay the proceeding, setting the stage for him to be sentenced just days before he is inaugurated on January 20 for a second term.

Four conservative justices – Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh – said they would have granted Trump’s request. Chief Justice John Roberts and Justice Amy Coney Barrett joined the court’s three liberals to side against Trump.

Judge Juan Merchan, the New York judge who oversaw Trump’s trial, had ordered sentencing in the case for Friday morning but has signaled that Trump will face neither penalties nor prison time.

The sentencing hearing is scheduled for Friday at 9:30 a.m.

In a brief, one-paragraph statement, the court said that some of Trump’s concerns could be handled “in the ordinary course on appeal.” The court also reasoned that the burden sentencing would impose on Trump’s responsibilities is “relatively insubstantial” in light of the trial court’s stated intent to impose no penalty.

The fact that trump was so desperate to avoid being sentence makes me happy about this ruling

Noteable: Justice Merchan grants *audio recording* of Trump's sentencing tomorrow to be released after the proceeding.

Reporters, myself included, are wondering whether this telegraphs that Justice Merchan has some words for Donald Trump that he wants the world to hear...

and the biggest one of all is the over 1/2 billion $ to the state of NY (AG Tish James' case - although there were suggestions the judgement would probably be reduced by the appeals court but probably still be up in the hundreds of millions).

I'm surprised it was only a 5-4 decision, but then the court is very politically partisan, so I'll take that narrow victory also.

"In a brief unsigned order, a five-justice majority noted that Mr. Trump was not facing jail time and that he could still challenge his conviction “in the ordinary course on appeal.”

The majority included Chief Justice John G. Roberts Jr. and Justices Sonia Sotomayor; Amy Coney Barrett; Elena Kagan and Ketanji Brown Jackson. Four of the court’s conservative justices — Clarence Thomas, Samuel A. Alito Jr., Neil M. Gorsuch and Brett M. Kavanaugh — noted dissents without providing reasons.

... But the court opted to stay out of the case, despite having come to Mr. Trump’s rescue in a string of other recent matters. In July, the justices granted former presidents broad immunity for official acts, undermining a separate criminal case against Mr. Trump in Washington..."

The judge has already said he would not sentence him to jail time. SC rules hey you have to get sentenced to essentially not break the law in NY again for 4 years. SC thinks it makes them look fair and balanced. They do this a lot with rulings that have no real world impact IMHO.
