US supreme court rejects Trump bid to call off sentencing in hush-money case

The US supreme court on Thursday declined to delay Donald Trumps upcoming sentencing in his hush-money case.
Trump had asked the USs highest legal body to call off Fridays sentencing in the hush-money case after New York courts refused to postpone the sentencing by Judge Juan Merchan.
Merchan presided over Trumps trial and conviction last May on 34 felony counts of falsifying business records. Trump has denied wrongdoing.
Merchan has indicated he will not impose jail time, fines or probation, but Trumps lawyers argued a felony conviction would still have intolerable side-effects, including distracting him as he prepares to take office in just over a weeks time.

(4,938 posts)(per legal pundit on TV), legally it takes a sentencing hearing to label one as a FELON. Dumpy can still appeal the conviction but he will ALWAYS be referred to as a felon in his orange legacy.

(157,387 posts)I am happy that trump is not above the law. The briefs filed by trump's counsel were really sad and ridiculous. Basically it was the position of trump and his attorneys that trump was totally above the law

The high court on Thursday rejected Trumps emergency request to delay the proceeding, setting the stage for him to be sentenced just days before he is inaugurated on January 20 for a second term.
Four conservative justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh said they would have granted Trumps request. Chief Justice John Roberts and Justice Amy Coney Barrett joined the courts three liberals to side against Trump.
Judge Juan Merchan, the New York judge who oversaw Trumps trial, had ordered sentencing in the case for Friday morning but has signaled that Trump will face neither penalties nor prison time.
The sentencing hearing is scheduled for Friday at 9:30 a.m.
In a brief, one-paragraph statement, the court said that some of Trumps concerns could be handled in the ordinary course on appeal. The court also reasoned that the burden sentencing would impose on Trumps responsibilities is relatively insubstantial in light of the trial courts stated intent to impose no penalty.
The fact that trump was so desperate to avoid being sentence makes me happy about this ruling

(146,601 posts)and the biggest one of all is the over 1/2 billion $ to the state of NY (AG Tish James' case - although there were suggestions the judgement would probably be reduced by the appeals court but probably still be up in the hundreds of millions).

(79 posts)The judge has already said he would not sentence him to jail time. SC rules hey you have to get sentenced to essentially not break the law in NY again for 4 years. SC thinks it makes them look fair and balanced. They do this a lot with rulings that have no real world impact IMHO.
