(10,866 posts)5 Justices ruled birthright citizenship is guaranteed by the 14th amendment. The only way to change that (with this court) is a constitutional amendment.
Just because Kavanaugh said birthright citizenship could be overturned by legislation is irrelevant when a majority of Justices alread ruled otherwise.

(820 posts)The Court itself could change its ruling in the future. The makeup of the Court may change,or a new argument may be made, or perhaps a Justice just changes their mind? One key retirement and appointment could change the landscape of this issue as it did Roe v Wade. Constitutional guarantees are rarely that. To some degree our rights exist at the whim of five black robes. Irrelevant? No, but probably not something to worry about at this time.

(3,207 posts)When Trump threatened to deport U.S. born citizens he didn't like or disagreed with him he wasn't joking. This executive order was just a trial balloon for that. If the Supreme would've been so willing to ignore the plain text of the constitution in this case you can bet they would've done the same for future birthright citizenship cases too. Giving the President the power to disappear anyone he doesn't like through deportation born here or not.

(4,252 posts)85% of the population, over 220 million people, were born in the country. They are US citizens by virtue of being born in the US. All have ancestors who were not born in the US.
None of this has anything to do with birth right citizenship. No one is talking about stripping 220 million people of their citizenship. It is about white nationalism, and we shouldn't pretend that it is about anything else.
Right here the other day I saw someone post "I agree that people shouldn't hop across the border to have a baby." Sure. Those women in Norway go into labor and then hop on a plane to the US. Oh, wait. It isn't Norwegians they are worried about, is it? This insanity isn't about foreigners, either. It is Black and brown people who are being targeted in various ways, no matter their status, no matter where they were born or where their parents were born.
