We Americans have been charged ridiculously high prices for the last year, even though NONE of us supported the idea of tariffs to foregin manufacturers.

The Court of International Trade has overseen large-scale refunds before. Congress enacted a harbor maintenance tax in 1986 that was assessed on the value of all cargo into and out of U.S. ports. The Supreme Court ruled part of the tax was unconstitutional in 1998. The Court of International Trade oversaw a refund process involving more than 100,000 claimants that was managed by Judge Jane Restani, who remains on the court.

Trade experts said the government has tracked tariff payments and improved recordkeeping systems that should make it easier to determine the size of refunds. Small businesses have called on the Trump administration to issue automatic repayments and have expressed concern that the government might scrutinize entry paperwork in a way that slows the refund process.

How will companies get refunds now that the US Supreme Court has rejected Trump's tariffs?

I already have mine prepared. We went through this Donald's first time in office with the 301 (China Tariffs). In that case specific hts us codes were given time specific exclusions and retroactive refunds.

If the trade compliance officer is managing the work product correctly - the request for refund is simple.

Tariff refunds for companies that paid tens of billions were left unresolved by the Supreme Court, which ruled on Friday that President Donald Trump didn’t have legal authority to impose the duties under an emergency law.

The ruling will kick off what could be a prolonged battle for importers and retailers to try to recoup as much as $170 billion in tariffs they’ve already paid to the US government.

Among the major questions left unanswered for US importers are the prospects and the process for recouping the money the government collected over the past year under the International Emergency Economic Powers Act. The vote was 6-3 against the Trump administration, with Justice Brett Kavanaugh writing in dissent.

“The court says nothing today about whether, and if so how, the government should go about returning the billions of dollars that it has collected from importers,” Kavanaugh wrote. “But that process is likely to be a ‘mess,’ as was acknowledged” during the court’s oral arguments in November.

US Customs and Border Protection so far has collected an estimated $170 billion in tariffs imposed by Trump using the International Emergency Economic Powers Act, the law at the center of the case, as of Dec. 14.

The court ruled that using IEEPA to impose tariffs wasn’t lawful, but the justices didn’t address whether importers are entitled to refunds, leaving it to a lower court to sort out those issues. The litigation will return to the US Court of International Trade for the next round of legal wrangling.....

While waiting for the justices to rule, more than 1,500 companies have filed their own tariff lawsuits in the trade court to put themselves in line for tariff refunds, according to a Bloomberg analysis.

The trade court in recent months has pressed the Justice Department for at least a hint of how it plans to handle the refund issue if it lost at the Supreme Court.

In written submissions, government lawyers have said that the administration won’t fight the court’s authority to order officials to recalculate tariffs, but left open the possibility that it might try to limit which importers are eligible.

I have seen reports of people selling claims for tariff refunds.

But the Cantor thing is correct.

100k in Tarrifs.

They *bought* the entry and gave the Importer of Record $75K.

Refund - Cantor can request the refund full amount. They pocket the entire amount.

This is where Lutnick enters the chat. Look where his sons work and the *product* they created its them. IOR's are getting their refunds.

The money would have to be used to restore full funding for programs for the disadvantaged, at levels before 2025. If there's any left over, either distribute equally to reduce the deficit (which we all pay for one way or another ... deficits make sense at certain times but not as long running policy); or pay into the Social Security trust fund (no one wants Grandma's check cut by 35% a few years from now, do they); or a variety of other things that would either benefit the majority, or those most in need.

In addition to questioning the intelligence of the six justices in the majority - a very Trumpian thing to do - he said they were unpatriotic or disloyal and under the sway of foreign influence.

Trump will find himself before SCOTUS again. I am sure the justices are more mature than I but I'd be pissed.

The major corporation Cantor Fitzgerald, and already BOUGHT the returned tariff funds obligations from corporations at .20 cents on the dollar. He’s making huge sums from ff the ruling.
