The equal time rule was never applied to talk shows. But Brendan Carr, who has been looking for ways to go after The View, has been attempting to use the Equal Time rule to go after ABC/The View. Because of this, I think lawyers at CBS/Colbert advised Colbert of this new tactic by Carr, and Colbert exposed it.

So no, he was not required to do anything. CBS caved to empty threats and Colbert called them out on it.
