had an expiration clause written into it. I suppose an administration who didn't care about the rule of law could bulldoze it in, but it's not clear that the courts would uphold it. There's also the question of whether states are able to rescind ratification - I hope they can't, what with the calls for abolishing parts of the 14th amendment.

So pre-ratification, can states rescind their vote?

But after implementation there's no question that it's too late.

There was no greater defender of equal rights than RBG… and even she said it cannot be done.

It's clear that from a legal point of view (i.e. that the argument otherwise doesn't have consensus) the ERA from the 1970s is dead. Why we don't hold a prominent vote for a new one every congress, put it in every Democratic state of the union, etc., is beyond me.

I think most of the lobbying and murmuring is about trying to revive the 70s amdt. I know Collins and Murkowski were sponsors in the past.

I don't think it gets to 2/3, but rub the opposition in it for a generation.

Nor do archivists have any discretion to exercise in the matter (any more than VP Pence could reject electors).

Not, for that matter, does the MN Secretary of State have the power to determine a quorum in the state house.
